4) Adoption of the Minutes from Previous Council Meetings
Warden LeBlanc thanked Deputy Warden Doucet for chairing the meeting in his absence and chaired the meeting from this point forward.

5) Business Arising from Previous Meetings
5.1 Resolution – FCM Municipal Asset Management Program
The Municipality is in the process of drafting its Asset Management Plan. Asset management plans allow municipal units to better manage their infrastructure by planning for both capital and operational costs incurred over the useful life of an asset. It is an important planning document which the Province will soon make mandatory for all municipalities throughout Nova Scotia. During the August 25, 2020 meeting of the Asset Management Cohort, the possibility of applying to the Federation of Canadian Municipalities (FCM) for funding assistance to help offset the cost of drafting these plans was discussed. Under the FCM’s program, assistance in the amount of 80%, up to a maximum of $50,000, is available for the preparation of these plans. Should municipal units apply jointly or as a group, this percentage increases to 90%. The other five municipalities participating in this program have all agreed to participate together in an application to the FCM. The CAO is recommending the Municipality follow suit given the considerable savings this will yield in terms of staff time. In doing so, the proposed financial contribution from the Municipality of Clare would be $3,990. Council agreed and passed the following motion:

BE IT RESOLVED that Council directs staff to apply for a grant opportunity from the Federation of Canadian Municipalities’ Municipal Asset Management Program for Asset Management Inventory and Capital Projections.

BE IT THEREFORE RESOLVED that the Municipality of the District of Clare commits to conducting the following activities in its proposed project submitted to the Federation of Canadian Municipalities’ Municipal Asset Management Program to advance its asset management program:

Activity 1: Prepare an inventory of major assets including roads, sidewalks, sewer, storm, trails, fleet and municipal-owned buildings and structures in spreadsheet and GIS

Activity 2: Undertake condition assessments on all municipal infrastructure.

Activity 3: Prepare State of Infrastructure Reports, a Preliminary Capital Program and Fact Sheets for public information.

BE IT FURTHER RESOLVED that the Municipality of the District of Clare commits $3,990. from its budget toward the costs of this initiative.

6) Warden’s Activity Report – Warden Ronnie LeBlanc
The Warden provided a summary of the meetings and events he attended since the last Council meeting.

July 28 – Attended a special meeting of the Board of Governors of Université Sainte-Anne via Microsoft Teams.

July 18 – Attended the unveiling of the new truck at the Meteghan Fire Department.

August 12 – Attended a consultation session, hosted by Upland, as part of the Tourism Public Spaces Development and Improvement Project.

August 15 – Attended the raising of the flag at the Municipal Office to celebrate National Acadian Day

August 15 – Gave a speech at the “Grand March” for the ESDC graduating class of 2020.

August 18 – Attended a second consultation, hosted by Upland, as part of the Tourism Public Spaces Development and Improvement Project.

August 21 – Attended a meeting with ACOA and other key stakeholders to discuss the possibility of creating an action plan to address the lack of housing in the Municipality of Clare.

September 14 – Attended a meeting of the Board of Governors of Université Sainte-Anne via Microsoft Teams.

7) Official Statements from Members of Council
As this is his last Council meeting, Councillor Hector Thibault thanked all the residents in his district for electing him as their Councillor. Councillor Thibault stated that it has been a pleasure to represent District 3 and thanked Warden LeBlanc, the other Councillors, the CAO, and staff for their work over the past eight years. In closing, Councillor Thibault expressed his well wishes for the new Council which will be elected in October.

Warden LeBlanc thanked Councillor Thibault for his years of service to his district and to the community at large. He went on to state that Councillor Thibault’s heart is in his community, that his hard work has not gone unnoticed, and that it has been a pleasure to serve with him on Council. In closing, Warden LeBlanc wished Councillor Thibault well in his retirement.

Councillor Brian Comeau received a card from Marie Adèle and Gilbert Deveau of Meteghan River thanking Council for sending a letter to NSTIR requesting the installation of a guard rail on Allée des Black Road. The guard rail is now installed.

Councillor Carl Deveau thanked municipal staff for all their hard work in response to the challenges posed by Covid-19.

10.2 Audit Committee – Councillor Brian Comeau
The Audit Committee met with the auditors (Grant Thornton) on September 9, 2020 to review the Municipality’s 2019/2020 Audited Financial Statements. During this meeting, the auditors highlighted the Municipality’s sound financial position as well as the cooperation they received from management and staff throughout their audit engagement. The auditors once again gave the Municipality a clean audit opinion. In light of this opinion, the Audit Committee is making the following two recommendations for Council’s consideration:

  1. That the annual operating surplus of $731,022 for the 2019-2020 fiscal year be transferred from the Operating Fund to the Operating Reserve.
  2. That the Municipality of the District of Clare approve the 2019-2020 Audited Financial Statements for the Municipality of the District of Clare, as prepared by Grant Thornton.

11) New Business
11.1 Motion to transfer $731,022 from the Operating Fund to the Operating Reserve

MOVED BY Councillor Carl Deveau and SECONDED BY Councillor Yvon LeBlanc that the annual operating surplus of $731,022 for the 2019-2020 fiscal year be transferred from the Operating Fund to the Operating Reserve.

11.2 Motion to approve the 2019-2020 Audited Financial Statements

MOVED BY Councillor Eric Pothier and SECONDED BY Councillor Danny Hill that the Municipality of the District of Clare approve the 2019-2020 Audited Financial Statements for the Municipality of the District of Clare, as prepared by Grant Thornton.

11.3 Motion to Award Grant – Clare Columbus Club

MOVED BY Councillor Carl Deveau and SECONDED BY Deputy Warden Nil Doucet that the Municipality of the District of Clare award a grant in the amount of $10,000 to the Clare Columbus Club for renovations to its building and that these funds be taken from Grants to Organizations.

11.4 Motion to Rescind Motion from June 17, 2020 – Track and Field Facility
Deputy Warden Nil Doucet chaired this section of the meeting.

MOVED BY Councillor Danny Hill and SECONDED BY Councillor Carl Deveau that the Municipality of the District of Clare rescind the following motion from June 17, 2020:

MOVED BY Councillor Eric Pothier and SECONDED BY Councillor Carl Deveau that the Municipality of the District of Clare approve funding for the proposed Track and Field Facility at Université Sainte-Anne in the amount of $400,000 and that these funds be taken from the Municipality’s Operating Reserve.

11.5 Motion to Approve Funding – Track and Field Facility

MOVED BY Councillor Eric Pothier and SECONDED BY Councillor Hector Thibault that the Municipality of the District of Clare approve funding for the proposed Track and Field Facility at Université Sainte-Anne in the amount of $400,000 and that these funds be taken from the Municipality’s Capital Reserve.

11.6 Motion to Sign a 10-year Lease – Université Sainte-Anne

MOVED BY Councillor Hector Thibault and SECONDED BY Councillor Carl Deveau that the Municipality of the District of Clare sign a 10-year lease with Université Sainte-Anne (with option for renewal) to confirm use of the land on which the proposed track and field facility will be located, as well as responsibility for the administration and ongoing maintenance of the facility and as a means of ensuring long-term community access.

11.7 Motion to Approve Change Order – Tourism Public Spaces Development and Improvement Project
At the Council in Committee meeting on September 2, 2020, the CAO recommended that Council contribute an additional $30,000 to the Tourism Public Spaces Development and Improvement Project to allow RHAD architects to prepare technical plans, costing, and specifications for the Clare Veterans Centre. Since that meeting, the CAO has received updated cost estimates from RHAD, and the new estimate is closer to $50,000. This additional work is required in order to move the project forward. The proposed change order is compliant with the Municipality’s procurement policy. Whereas the amount requested is less that than 10% of the anticipated project costs and given the strategic importance placed on this project by Council, the following two motions were passed:

MOVED BY Councillor Yvon LeBlanc and SECONDED BY Councillor Carl Deveau that the Municipality of the District of Clare amend the motion to recommend from September 6, 2020 by increasing the additional contribution towards the Tourism Public Spaces Development and Improvement Project, for the completion of technical drawings for the Clare Veterans Centre, from $30,000 to $50,000.

MOVED BY Councillor Hector Thibault and SECONDED BY Councillor Danny Hill that the Municipality of the District of Clare contribute up to an additional $50,000 towards the Tourism Public Spaces Development and Improvement Project for the completion of technical drawings by RHAD Architects for the Clare Veterans Centre, including all structural, mechanical, electrical and civil sub-trades, as well as cost estimates and project specifications, and that these funds be taken from the Municipality’s Operating Reserve.

11.8 Motion to Award Tender – Repairs to the Bridge at Joseph and Marie Dugas Park
The decking on said bridge is deteriorating and in immediate need of repair. The Nova Scotia Department of Transportation and Infrastructure Renewal (NSTIR), accompanied by the Municipality’s Assistant Building Inspector, have confirmed that the bridge at the entrance of the Joseph and Marie Dugas Park in Belliveau Cove is structurally sound. In keeping with the Municipality’s procurement policy, an invitational tender was issued for this work. A total of three bids were received. Upon review of the bids, it is the recommendation of both the CAO and staff that the Municipality accept the bid from Blue Bay Construction Limited in the amount of $5,600 plus HST. It is further recommended that the Municipality accept the offer from Blue Bay Construction Ltd. to also replace the second layer of decking given the strong probability that it to is damaged. Doing so would add an additional $1,000 plus HST to the total bid price. Council agreed and passed the following motion:

11.9 Motion to Approve Funding – Housing Strategy and Action Plan
Housing or the lack thereof is a significant challenge in Clare and a hindrance to private sector growth. Both the Warden and CAO have been in discussions with ACOA and private sector leaders including Riverside Lobster International Inc., A.F. Theriault & Son Ltd., and Comeau Sea Foods Ltd. as to what actions can be implemented over the short and long term to address this issue. Housing is also an issue for low income families, young professionals, and the aging population. The logical first step, as agreed to by all parties at the table, was the creation of a municipal housing action plan focusing on tangible initiatives involving available (or soon to be available) properties of strategic interest. ACOA officials expressed a willingness to fund up to 75% of the cost of the plan, up to a maximum of $75,000, with the Municipality to fund the remaining 25%.

Warden LeBlanc sees great potential in this project as housing is a major priority of Council and this initiative could help attract and/or retain more people to/in Clare. Council agreed and passed the following motion:

MOVED BY Councillor Carl Deveau and SECONDED BY Councillor Eric Pothier that the Municipality of the District of Clare contribute an amount equal to 25% of the cost of a proposed Housing Strategy and Action Plan for the Municipality, up to a maximum of $25,000, and that these funds be taken from the Municipality’s Operating Reserve.

11.10 Motion to Send a Letter – Clare Organization Representing Persons with Disabilities
The Clare Organization Representing Persons with Disabilities (CORD) will be merging with l’Atelier de Clare. As part of this merger, l’Atelier will be assuming management responsibility for the Café Lisa T. Council is aware of this merger and has previously expressed its support for it. However, as part of an existing memorandum of understanding signed between Université Sainte-Anne and the Municipality, l’Atelier requires the support of the Municipality prior to assuming responsibility for the Café Lisa T. Council passed the following motion:

11.11 Motion to Send a Letter – Henry Hicks Road

MOVED BY Councillor Brian Comeau and SECONDED BY Councillor Hector Thibault that the Municipality of the District of Clare send a letter to the Nova Scotia Department of Transportation and Infrastructure Renewal asking for calcium chloride to be applied onto Henry Hicks Road in a more timely manner.

11.12 Motion to Send a Letter – Peter Dugas Road
The section of the Peter Dugas Road from Highway 1 to the Meteghan Wharf is heavily utilised by commercial (and some residential) traffic and is currently in a state of disrepair. Year over year, the state of the road has worsened, and its width has narrowed, creating a hazard for vehicles and pedestrians alike. Warden LeBlanc is asking for a motion to send a letter be sent to the Nova Scotia Department of Transportation and Infrastructure Renewal (TIR) and to the MLA for Digby-Clare, Mr. Gordon Wilson, stressing the importance of this matter and requesting that this section of the Peter Dugas Road be immediately added to the provincial paving list as a high priority. Council agreed and passed the following motion:

MOVED BY Councillor Eric Pothier and SECONDED BY Councillor Yvon LeBlanc that the Municipality of the District of Clare send a letter to the Nova Scotia Department of Transportation and Infrastructure Renewal and to the MLA for Digby-Clare, the Honourable Gordon Wilson, asking that Peter Dugas Road (from Highway 1 to the Meteghan Wharf) be added to the provincial paving list due to safety concerns.

11.13 Motion to Send a Letter – Duffy Road
The Duffy Road has traditionally served as an important point of access to Highway 1 in Saulnierville for many users of the trail system (former CN Railroad) including ATVs, cyclists, hikers, etc. As such, brush cutting services along the Duffy Road were provided by the Nova Scotia Department of Transportation and Infrastructure Renewal (NSTIR). However, following a change in local management, NSTIR brush cutting efforts along the Duffy Road have ceased. Councillor Brian Comeau is requesting the Municipality send a letter to NSTIR asking for the resumption of brush cutting services along the Duffy Road. Council agreed and passed the following motion:

11.14 Motion to Approve Policy – Destruction of Documents Policy
At the request of both Council and the CAO, staff has drafted a Destruction of Documents Policy. The purpose of this policy is to ensure the records of the Municipality are protected from premature destruction and properly disposed of once their value ceases. Previously this was done via a by-law and required a motion of Council each time staff needed to dispose of documents. The proposed policy alleviates this administrative burden and will eventually form part of a larger Records Management Policy adopted and implemented by the Municipality. Council passed the following motion:

The Municipality received a request to name a private road. Seven of the ten affected residents (70%) are in favor of the proposed name. The request respects the Municipality’s current road naming policy in that it is bilingual, not currently in use anywhere else in the Municipality and satisfies the minimum required approval rate of 66.6%. Staff is recommending the proposed name. Council agreed and passed the following motion:

11.17 Motion to Authorize Municipal Credit Card – Clare Health Centre Manager
The Manager at the Clare Health Centre has traditionally been issued a municipal credit card. With the former Manager now retired and a new Manager in place, the previous card is no longer valid, and a new card is required. In order to issue a new card, the Municipality’s financial institution requires a motion from Council. As such, the CAO is requesting Council authorize the new card, with the same $2,000 credit limit as before. Council passed the following motion:

11.18 Motion to Send a Letter – Chemin de la Montagne Road
For some time now, residents of the chemin de la Montagne Road have expressed their concerns and displeasure regarding fires and excessive noise. Following regular monitoring and patrolling by enforcement officers from the Nova Scotia Department of Lands and Forests, as well as members of the local RCMP detachment, the situation had improved. Unfortunately, with the recent reassignment of the aforementioned officers from Lands and Forests due to Covid-19, the situation has once again devolved with instances of excessive noise and illegal fires now on the rise. Councillor Brian Comeau is requesting the Municipality send a letter to the Nova Scotia Department of Lands and Forests requesting a resumption of enforcement efforts along the chemin de la Montagne Road. Council agreed and passed the following motion:

11.19 Motion to Award Tender – Bourneuf Wharf Road
The Municipality owns oceanfront land at the end of the Bourneuf Wharf Road in Grosses Coques. In an effort to curtail ongoing erosion, the Municipality has tendered for the placement of 200 feet of armor stone along its property to act as a stone barrier. Two bids were received. Although very close in price, it is the recommendation of the CAO that Council award the tender to the lower bidder, Gary Belliveau Construction and Excavation Limited, in the amount of $19,700 plus HST. Council agreed and passed the following motion:

The Municipality received a request to name a private road. All of the three affected residents (100%) are in favor of the proposed name. Staff is recommending the proposed name.

A resident of the Sears Mullen Road approached Councillor Danny Hill regarding the distance her 9-year old son must walk to his bus stop. Presently, he must walk 0.4km at 6:45am to get to his bus stop on Highway 340. Both parents consider this excessive and dangerous and are unable to bring their son to his bus stop themselves. Requests to change the bus stop have been denied by the Tri County School Board since it goes against the Board’s policy stating that stops will not be added unless students are more than 0.8km away from the nearest bus stop. The road in question is a government maintained road which previously had several bus stops. Councillor Hill would like the CAO and staff to look into this matter in an effort to assist the family in question. Council agreed.
